In Queensland there are advertising restrictions set down in legislation to protect the community from unrealistic expectations that may arise as a result of advertised medical services. A balance must be struck between the amount of restrictions placed on advertising and the need to provide information to consumers about medical services, so that they can make informed choices.
With that in mind the Medical Board of Queensland has responsibility for enforcing the restrictions on advertising of medical services.
A breach of these provisions may result in prosecution and may also be considered evidence of unsatisfactory professional conduct, leading to investigation by the Board, either on its own motion or in response to a complaint.
